"He said the arrests by the DA's office and the New York Police Department represent the first time that Internet gambling charges have been brought since President George W. Bush signed into law last month the Unlawful Internet Gambling Enforcement Act."
This does not say that charges were brought under the UIGEA, but it is easy to misinterpret it that way.

To my knowledge this case is not being prosecuted under UIGEA inasmuch as the investigation on this case dates back well over 2 years. Have you heard something to the contrary?

NYPD busts $1 billion a year web gambling ring
By Associated PressNEW YORK - More than two dozen people, including a professional baseball scout and a high-stakes poker player, were charged Wednesday in connection with a billion-dollar-a-year gambling ring that rivaled casino sports books.
The illegal betting scheme was orchestrated through a Web site called Playwithal.com, run by the poker player, James Giordano, 52, of Pine Crest, Fla., according to Police Commissioner Raymond Kelly and Queens District Attorney Richard Brown.
A break in the case came last year when investigators secretly hacked into a laptop computer that Giordano had left in a Long Island hotel while attending a wedding, police said. He was arrested early Wednesday by FBI agents who had to scale the walls of his fortess-like Florida compound.

NY is such a confusing place. First they prosecute Jay Cohen for Wire Act iolations. Then they release Peter Dicks because there is apparently no law in NY against net gambling. Now they are using UIGEA to carry out prosecutions, which should be a federal matter. Is a little consistency too much to ask?

NEW YORK -- Criminal charges have been brought against more than two dozen people and corporations in four states in connection with a billion-dollar-a-year gambling website, authorities said yesterday.
Authorities declined to name any of those charged. One of the corporations is an offshore Internet company with an American counterpart, said Kevin Ryan, a spokesman for Queens District Attorney Richard Brown.
Ryan said the case is "one of the first times that a web designer corporation and the companies that maintain the websites have been charged."
