Incorrect. Please state who made this claim. Just because the Justice Department "considers" Internet gambling illegal does not in any way mean it is illegal - otherwise they would state that "Internet gambling is illegal".

There are only a few states that have declared Internet gambling expressly illegal. The federal government is not considered to have jurisdiction over the Internet, nor over gambling, as it has already allowed individual states to determine whether they will allow gambling or not. Nevada is one of those who regulates gambling - but to bring the entire United States into this is quite unwarranted.

Justice Dept. Drafts Bill to Ban Internet Gambling

The U.S. House of Representatives failed last month to pass the Internet Gambling Prohibition Act (HR 3125), but now Interactive Gaming News reports that the Justice Department introduced its own bill to prohibit online gambling on July 27. Rep. John Conyers (D-Mich.) is sponsor of the Comprehensive Internet Gambling Prohibition Act of 2000 (HR 5020). The newer bill aims to prohibit Internet gambling by extending the almost 40-year-old Wire Wager Act, which prohibits interstate gambling on sports "by phone or wire." It is possible that many representatives that oted against HR 3125 will favor HR 5020. However, Congress can take no action on either HR 5020 or HR 3125 until it reconvenes on September 6.

Yes, THIS is why the credit card companies blocked it. Not because it's illegal, but because they were paying the bills as a result. To my knowledge, no individual has ever been charged with internet gambling as a crime, let alone indicted or convicted. RUNNING an internet gambling site in the US is definitely illegal, but using one is much fuzzier.

There is no existing federal law that makes Internet gambling a crime. There has been much debate as to whether the "Wire Act" which was enacted prior to the Internet would apply and thus make it illegal...but this has never held up in any court (that I'm aware of). I seem to remember a lawsuit in Louisiana where it did not hold up but that case is being appealed.

Unless your state has specific Internet Gambling Laws, (I think there are about 5 now?), then you should be ok. I know Missouri, Minnesota, Nevada, California and Arizona have specific laws. I can't remember any others. Anyone care to add to the list?

Sorry but I didn't see the original post with the statistics but...

If the survey was based on 389 people is statistically unsound. I have seen and done many surveys (in advertising industry) and that is a miniscule sampling.

Like you said G2B the Internet does attract people that have specific interests. A large number of sports card collectors that have internet access have bought or sold something online.

The odds are that a ery large percentage of people that have a gambling problem will gravitate to internet gambling. It doesn't mean that people that gamble online (that don't already have a problem) will develop a gambling problem.

Antigua will continue developing its Internet gambling industry despite pressure from the United States to prohibit the practice, the finance minister said Wednesday.

Finance Minister Errol Cort said at least 10 new online gambling companies will open on the Caribbean island next year, joining 14 others that already have been granted operating licenses.

Cort said the new companies will generate some 500 new jobs and more than US$2 million (euro1.7 million) in gambling licenses fees.

The United States contends that Internet gambling should be prohibited because it iolates some U.S. state laws. Antigua says the U.S. position is contrary to global trade rules.

Antigua's has taken the dispute to the World Trade Organization, which has yet to rule on the matter.

New revenue projections submitted to congress by Representative Jim McDermott (D-WA) show that regulating internet gambling would generate between $6 billion and $15 billion in revenues for the U.S treasury in the first five years of enactment and between $17 billion and $48 billion in the next decade.

These facts alone should get lawmakers attention as stunning deficits mount in the areas of social security, health care, and education.

These revenue figures take into account that some professional sports leagues may decide to opt-out and some states may choose to allow online gaming in addition to their brick and mortar gaming.

No, Got2Bet I strongly disagree with you on this one. It is a fact that most jurisdictions officially prohibit internet gaming. They don't do it to protect their citizens but to protect country/state gambling monopolies.

With this same argument internet casinos can only accept players from jurisdictions where internet gambling is legal - which are a handful (including the UK). In fact, if my memory serves me right there was a casino which tried to follow this policy (it was bossmedia powered - if i'm not mistaken casino atlantis..it was tied to a US Vegas group) and it ended up closing its doors due to lack of business

And the internet casinos do not limit themselves to promoting their casino in legal jurisdictions - they accept players worldwide.

Casinos operate within a state and therefore under state laws, not federal laws. If a state wants to allow casinos, the federal government has no say in the matter at all.

The federal government does, however, have the power to regulate interstate commerce, which is any commerce that occurs across state lines, which internet gambling does. So they have the power to pass laws regarding internet gambling.

The two faced issue is making internet gambling for lotteries and horse racing legal, not them leaving casinos legal.

The Unlawful Internet Gambling Enforcement Act

One of the few positive things about The Unlawful Internet Gambling Enforcement Act for US players is that jurisdiction in US courts may exist RETORACTIVELY to sue Internet casinos. (New legislation cannot criminalize acts ex post facto, but it can be retroactive in civil disputes.) Since the new law defines that all wagers placed on PC’s in the US, now are wagers placed in the US, then US courts can assert jurisdiction…if they want. If RTG is based in Atlanta, then it becomes easier to collect. If Internet gambling wasn’t illegal previously, then that is good for the player. Generally, if a gambling contract is illegal, it is usually unenforceable in the states, BUT you might invoke the equitable powers of the court to recover wagers placed as unjust enrichment.

Don’t get me started about the Casino Mouseketeer. The double standard that he holds weasels like Cloud/Curran compared to how he criticizes non-casino posters making factuall...

NY is such a confusing place. First they prosecute Jay Cohen for Wire Act iolations. Then they release Peter Dicks because there is apparently no law in NY against net gambling. Now they are using UIGEA to carry out prosecutions, which should be a federal matter. Is a little consistency too much to ask?

Of course they know it is not the online gambling sites
attempting to influence matches..but it is hard to sue a crime boss.

This is a good scape goat to make them look like they are doing
something publically... it is a tough situation to be in and I feel
sorry for both sides.

I would hate to see tennis betting go, as it is the only sport I know enough about to place an intelligent bet on

I'm a bit confused by Ireland. I thought gambling was illegal there, and that they are only now setting up to regulate it. But then I see Trade Sports operating out of Dublin, and there's Paddy Power and a few others, even Yahoo runs a betting exchange there. Do they just not think internet gambling is really gambling, or what?

This does not say that charges were brought under the UIGEA, but it is easy to misinterpret it that way.

This looks like a ery close match to what I surmised above. But the last bit is totally laughable, considering that nearly every university has free net access and this "traditional association" should have been blown away a long time ago by cheap and free Net access (Netzero, as an example), community services such as libraries, etc.

Seems to me someone else wanted to get their name in lights. I wonder who funded that study...

German states clamp down on Internet gambling

As reported in InfoPowa bulletins earlier this week, the German states have literally cast the die by imposing a protectionist accord to halt online gambling in the country.

The move is sure to have serious repercussions from major international gambling groups who have threatened to litigate, and the European Commission which has already indicated that the ban is contrary to EU treaty principles on the free passage of services and trade between member nations.

All 16 of Germany’s states have ratified the accord which, as of 1 January, prohibits foreign remote gambling operators from offering their services to German customers. Restrictions have also been placed on the advertising of gambling services in Germany.

The new online gambling laws will be alid until 2011.
