Technically, I believe, you are even suppose to pay taxes if you are a loser but I'm not sure how much it is enforced. Say for instance that you have $40,000 in winning sessions and $39,000 in losing sessions, you have to pay taxes on the $40,000, not the $1000 profit. So, if you have $5000 in winning sessions and $11,000 in losing sessions (not like any whore would) you would have to pay tax on the $5000, not $0. I think the law was not designed lottery winners, not poker players.
