If the South African government accepts a draft amendment bill passing it into law, then Internet and mobile phone betting will become legal for the first time. The bill outlines not only a framework for legislation for operators of online gaming properties, but also a a licensing system for both the provider and the end users.
This is welcome news indeed to South african interest groups and offshore gaming companies alike. Once legalized, the South African provincial government can earn revenue from independent operators who can move into the market and provide gambling services. South African trade and industry deputy director-general Astrid Ludin said that "The manner in which gaming proceeds would be taxed still had to be determined" She also said that a key challenge in drafting the proposed legislation was to find a way to effectively regulate anything on the internet and how to prevent money-laundering. Online and mobile gambling was deemed illegal by the National Gambling Act of 2004. This act came into law after the South African government decided that more time was needed to conduct conclusive research into interactive gambling. A report compiled by a National Gambling Board committee along with the recommendations of a national gambling policy committee consisting led to the draft amendments. The National Gambling Board conducted research on other countries that had regulated online and mobile betting in some form, those countries included the UK, the US and Australia.
In direct contrast to the U.S., which earlier this year decided to outlaw internet gambling, the South African government decided to allow interactive gambling within a regulated framework.
