I am from NY, and I can tell you that there is no NY state law banning online poker. In fact, it has been upheld in court a persons right to gamble in NY state. (Tested in courts and upheld)
What is outlawed in NY is promoting gambling, such as running underground casinos, etc.
NY has also gone on the books as stating that a business, running a legal operation in its home country does not violate NY state law, because the action is taking place in a legal jurisdiction. This is why they let the SportingBet exec go free after customes agents detained him on warrents in Louisiana. He was breaking no laws in NY.
How NY got on that list I would like to know, because it certainly is not illegal to play online poker in NY.
Don't take the prima list at face value, as it is not based on fact but fiction.
How is it based on fiction when Prima/Microgaming are effectively executing the ban in the state of NY? By the way, New York is also on Action Network's list of banned states as well.
In summary, we have two groups of corporate attorneys opinions v. one internet message board poster/poker players opinion. Hmmm.
Show me in NY state law were it says playing poker is illegal? Would you like to see the two court cases in NY that said players can gamble? Would you like to see the recent press release from the governor of NY about the issue of gambling sites?
Sorry bud, I don't care what a site says, I care what NY law says.
To answer your question, it is based on fiction, because the press release says NY bans online poker. It doesn't. The case with the other states I have no clue about as I do not reside in those states.
And fyi, I have talked to two seperate lawyers on this matter when we were planning on hosting a chartiable poker game.
You are quick to dismiss it, so show me in NY state law where playing poker is illegal? Show me one court case where someone was tried for playing poker in NY?
