Casinos operate within a state and therefore under state laws, not federal laws. If a state wants to allow casinos, the federal government has no say in the matter at all.
The federal government does, however, have the power to regulate interstate commerce, which is any commerce that occurs across state lines, which internet gambling does. So they have the power to pass laws regarding internet gambling.
The two faced issue is making internet gambling for lotteries and horse racing legal, not them leaving casinos legal. |
