Advertising, in the United States, is covered by the free speech laws.
And yes, online gambling is not illegal. Placing sports bets over the telephone is illegal. The DOJ keeps trying to pretend that applies to online gambling, but it doesn't. And that is why they try to pass a law making it illegal year after year after year.
That is the entire background of it. Also, the Communications Commission (a government body) concluded in another matter last year that the internet and the telephone are in no way the same thing.
There are more myths floating around regarding legality than you can shake a stick at.
