It's true that it could constitute a number of different crimes - fraud, fraudulent behaviour and forgery of documents all come to mind. There's probably a few more you could get yourself tangled in if you're not careful, or completely careless... damn, you probably need wear a t-shirt with your account logins and opt for a no-lawyer-trial where you answer "Yes" to every question to get convicted actually.
Bottom line is there are a number of ways you could do this that will render any proceedings against you useless. Legislation is absolutely toothless in this area since there are only doubtful ways to carry the burden of proof, or more likely drag it behind, uphill. A common problem in cyber-crime, just look at the whole file-sharing business. Does an IP really represent a person? Does a computer represent a person? How can we be sure nobody else accessed this particular computer or this particular IP at the time of the crime? How can we prove criminal intent? There's just no way of reaching beyond reasonable doubt.
Zeejustin logged into six different accounts and entered them all in the same tourney, all from the same IP. Sure, he lost quite a bit of dosh but he's not a con, is he?
In my opinion, if there's law that cannot successfully be policed then the law needs to be changed. Meanwhile, I'll ask myself if taking advantage of the gaps, no sorry - chasms, in this legislation really is criminal behaviour? A simple tick in a box just can't mean all that.
I understand I'm taking a bit of a different view than most of you on the legal side of things and also maybe not taking the risk of getting on the poker sites black list as seriously. I'm still curious why some of you think gnoming is such a heinous thing to do. Come on, Strange, let's see some spilt beans here, I really think it actually is for this thread.
